الزحف العمراني وأثره على البيئة الزراعية (دراسة في ضوء القانون اليمني)

الملخص

     تتمحور إشكالية هذا الموضوع في الإجابة عن التساؤل الرئيسِ الآتي: ما أثر الزحف العمراني على البيئة الزراعية على ضوء القانون اليمني؟ كما هدفت هذه الدراسة إلى التعرف على أثر الزحف العمراني على البيئة الزراعية، ومعرفة موقف القانون اليمني من حماية البيئة الزراعية، وللإجابة على أهداف الدراسة وتساؤلاتها استخدم الباحثان المنهجَ الوصفي التحليلي؛ كونه يعد من المناهج التي يفضل أن تُستخدم في الدراساتِ القانونيةِ والإنسانية، وتوصلت الدراسة إلى أهم النتائج التي أبرزها يتمثل في الآتي: إن المناطق الزراعية لاسيما حول المدن قد تعرضت للزحف العمراني في ظل تدني دور الجهات المختصة في الحماية. كما تبين أن التشريعات القانونية والإدارية الخاصة بحماية الأراضي الزراعية تعاني من القصور التشريعي ومغيبة عن تنفيذ الحماية القانونية اللازمة في الواقع.

Urban Sprawl and its Impact on the Agricultural Environment: A Study in Light of Yemeni Law

    The problem of this study centers on responding to the following main question: What is the impact of urban sprawl on the agricultural environment in light of Yemeni law? This study aimed to identify the impact of urban sprawl on the agricultural environment and to determine the stance of Yemeni law regarding the protection of the agricultural environment. To answer the study's questions and achieve its objectives, the researchers used the descriptive-analytical approach, as it is considered one of the preferred methodologies to be used in legal and humanitarian studies.

    The study reached important results, most notably:  Agricultural areas, especially around cities, have been exposed to urban sprawl amidst the declining role of competent authorities regarding protection.  It was found that legal and administrative legislation regarding the protection of agricultural lands suffers from legislative inadequacy and is absent from implementing the necessary legal protection in reality.
