دور البيئة الرقمية في التحول نحو التقاضي الإلكتروني في القضاء اليمني

الملخص

تتمحور مشكلة البحث في الإجابة على السؤال الرئيسِ الآتي: ما دور البيئة الرقمية في التحول نحو التقاضي الإلكتروني في المحاكم اليمنية؟ كما هدفت الدراسة إلى معرفة البيئة الرقمية وأهميتها في التحول نحو التقاضي عن بعد في المحاكم اليمنية، ومن أجل تحقيق أهداف البحث والإجابة على تساؤلاته اعتمد الباحث على المنهج الوصفي التحليلي كونه من المناهج المناسبة في الدراسات القانونية والإنسانية، وتم تقسيم هذا البحث إلى ثلاثة مباحث، تضمن البحث الأول: تعريف البيئة الرقمية وأهميتها. بينما تناولنا في المبحث الثاني مقومات التقاضي الإلكتروني في تطوير القضاء اليمني، وفي المبحث الثالث: موقف التشريعات اليمنية من التحول نحو القضاء الرقمي. كما توصل الباحث إلي عددٍ من النتائج منها: أن القضاء اليمني ما زال يعمل بالنظام التقليدي ويحتاج إلى تحديث للانتقال الي التقاضي الإلكتروني.

The Role of Digital Environment in the Transition towards Electronic Litigation in the Yemeni Judiciary

Abstract

The research problem centers on answering the following main question: What is the role of the digital environment in the transition towards electronic litigation in Yemeni courts? The study aimed to understand the digital environment and its importance in the transition towards remote litigation in Yemeni courts. To achieve the research objectives and answer its questions, the researcher adopted the descriptive-analytical approach, as it is one of the appropriate methodologies in legal and humanitarian studies.

This research was divided into three sections:  Section one included the definition of the digital environment and its importance.  Section two addressed the constituents of electronic litigation in developing the Yemeni judiciary.  Section Three: Discussed the stance of Yemeni legislation on the transition towards a digital judiciary. The researcher reached a number of results, including: The Yemeni judiciary still operates under the traditional system and requires modernization to transition to electronic litigation.
