The Concept of Martyrdom for the Sake of Allah: A Study in Light of the Objectives of Sharia and Juristic Opinion Abstract
This study aims to examine the concept of martyrdom (Istishhād) for the sake of Allah in light of its objectives as derived from the Islamic legal texts and the opinions of Islamic jurists. It also seeks to distinguish legitimate martyrdom from the misconceptions that have emerged in the modern era, while highlighting the status and virtues of the martyr in Islam. Furthermore, the study analyzes the relevant Qur’anic and Prophetic texts, identifies their higher objectives (Maqāṣid al-Sharī‘ah), and examines the views of Islamic jurists regarding the meaning of martyrdom, the definition of a martyr, and the legal rulings related to seeking martyrdom. In addition, it presents the jurists’ opinions and evidence concerning these issues and discusses the role of legitimate martyrdom in deterring enemies.
The study adopted the inductive approach to collect the relevant Islamic legal texts and juristic opinions, the descriptive-analytical approach to analyze the evidence and derive the objectives of Islamic law, and the comparative approach to present and evaluate the opinions of the various schools of Islamic jurisprudence.
The study concludes with several significant findings, the most important of which are that martyrdom for the sake of Allah is a great act of worship that can only be attained when its prescribed legal conditions are fulfilled. It also concludes that the objectives of Islamic law strictly prohibit aggression against innocent people and reject the misuse of the concept of martyrdom as a pretext for violence or extremism. Moreover, the study demonstrates that a sound understanding of the Islamic legal texts contributes to correcting misconceptions and reinforcing the principles of justice and moderation that characterize Islam.
